ATTENTION:  CO-OP DIRECTORS; CHILD NUTRITION DIRECTORS, AND CHILD NUTRITION MANAGERS 

 

 

The purpose of this memo is to inform schools of the interim rule for Child Nutrition Programs: Flexibilities for Milk, Whole Grains, and Sodium requirements that will extend through school year 2018-2019.

 

For SY 18-19, the school meal flexibilities:

 

Milk: Allow the service of flavored fat free and 1% milk in all Child Nutrition Programs for K-12 students in the National School Lunch and Breakfast Programs, and for participants age 6 and older in the Special Milk Program and the Child and Adult Care Food Program without an exemption

 

Whole Grains: Allow state agencies to grant exemptions to School Food Authorities, upon request, for the use of enriched grain products in the weekly school menu along with whole grain-rich products (see process below to apply or renew)

 

Sodium Requirements: Retain sodium Target 1 for school meals to allow schools and children additional time to adjust to sodium reduction efforts 

 

Fall 2018, a final rule will address the flexibilities beyond SY 18-19.

 

Using the attached form, School Food Authorities (SFA) requesting exemptions for the first time may request an exemption for up to two (2) specific whole grain rich items.

 

The request of an exemption must include documentation supporting the Reason for Request and Efforts to Comply.  The Arkansas Department of Education, Child Nutrition Unit (ADE CNU) will respond to all requests in writing.  Approved exemptions are effective only for the 2018-19 school year.

 

Written approval by ADE CNU of an exemption request must be on file within the SFA, and all meal pattern requirements, as established in the Healthy Hunger Free Kids Act of 2010 at 7 CFR 210.10 and 7 CFR 220.8, MUST be met in order for the meal(s) to be reimbursable.

 

PROCESS TO REQUEST APPROVAL OF AN EXEMPTION for New Applicants:

  1.  Complete the Whole Grain Rich Exemption Request Form attached to this memo.
  2.  Submit the Exemption Request Form and supporting documentation to ADE CNU

 

PROCESS TO RENEW EXEMPTION for Previously Approved Applicants:

 

  1. To renew exemption from SY 17-18 to include SY 18-19, complete the following google form, https://goo.gl/forms/OHGm7QqFpeoH8mAi1.

 

The deadline to apply for an exemption or renew a prior exemption is September 14, 2018.
